This agreement records your consent, your health disclosure, and your acceptance of the risks involved in being tattooed. Complete it before your appointment.
Age and identity. I am at least 18 years of age. The identification I present at my appointment is genuine, is mine, and matches the name on this waiver. I understand service will be refused if it does not.
Permanence. A tattoo is a permanent alteration of my body. Removal is expensive, painful, often incomplete, and may leave scarring. I have considered this and am not acting on impulse or under pressure from any person.
Design, placement and spelling approved by me. Before the needle touches my skin I will review and approve the design, its size, its placement on my body and — where applicable — the exact wording, spelling, dates and numerals. I accept sole responsibility for errors in any text I supplied, and I understand the artist interprets custom work in his own style and that hand-applied work is never an identical copy of a reference image.
Truthful disclosure. Every statement I have made about my health, allergies, medications, pregnancy status and age is true and complete. I understand the artist relies on these answers, is not a physician, and gives no medical advice or diagnosis. If I am unsure whether a condition affects me, I will consult a physician before my appointment.
Not impaired. I will not arrive under the influence of alcohol, cannabis, or any drug that impairs judgment or clotting. I understand that the artist may refuse or stop service at any time, at his sole discretion, and that deposits are not returned in that event.
Risks I accept. Risks include but are not limited to: pain and swelling; bleeding and bruising; temporary or permanent skin discoloration; infection, including bacterial, fungal and bloodborne infection; allergic reaction to pigments, latex, soaps, adhesives or aftercare products; keloid or hypertrophic scarring; nerve or tissue damage; blowouts, blurring, patchy healing or ink loss requiring touch-up; interference with future MRI imaging; and reactivation of cold sores or other dormant conditions. I voluntarily assume all such risks, known and unknown, and accept full responsibility for any medical treatment and expenses arising from my tattoo.
Aftercare is my responsibility. I have received written and verbal aftercare instructions and agree to follow them exactly. I understand that sun exposure, swimming, soaking, picking, scratching, unclean environments, gym use, tanning and failure to moisturize can ruin a healing tattoo, and that the outcome of healing is outside the artist's control once I leave the studio.
Healing, fading and touch-ups. Tattoos fade, spread and change with time, sun, weight change and skin type. Results vary with individual skin, body placement and healing. Touch-ups, if I want them, are scheduled at the artist's discretion and may be charged at my own expense.
Deposits and payment. Deposits are non-refundable and non-transferable, are applied to the final session, and are forfeited for no-shows, late arrivals that prevent the work, cancellations or reschedules with less than the required notice. No refunds are given for a completed tattoo, including on grounds of subjective dissatisfaction or a change of heart.
Release and waiver of claims. In consideration of receiving this tattoo, I release, waive and discharge the artist, Demiurgeos, and its owners, employees, agents, affiliates and the studio premises from any and all claims, demands, damages, actions and causes of action of any kind, whether known or unknown, arising out of or related to the tattoo process, its result, or its healing — including claims of injury, infection, scarring, allergic reaction, property damage or dissatisfaction — to the fullest extent permitted by law. This release does not apply to gross negligence or willful misconduct. I further covenant not to sue on any claim released here, and I agree to indemnify and hold harmless the released parties from any claim brought on my behalf arising from my own failure to follow aftercare or my failure to disclose a condition.
Artwork ownership. The artist retains all copyright and reproduction rights in the artwork and any drawings, stencils or digital files created for me. I receive the tattoo on my body, not ownership of the design, and I will not reproduce or license the artwork commercially without written permission.
Questions answered. I have had the opportunity to ask any question about the procedure, the risks, the design and the aftercare, and every question I asked was answered to my satisfaction. I have read this entire document, or had it read to me, and I am signing it freely.
Governing law. This agreement is governed by the laws of the State of Florida. Any dispute will be brought exclusively in the state or federal courts located in Broward County, Florida. If any provision is found unenforceable, the remainder stays in full force. This document is the entire agreement between us regarding this tattoo and supersedes any prior conversation.
This waiver is retained as part of your client record as required by Florida Administrative Code 64E-28. The artist reserves the right to refuse service to anyone, at any time, for any lawful reason. Submitting this form does not create or confirm an appointment.
